1. Website Policy
1.1 The Site provides users with access to the sale of jewellery, watches, and related items online (the “Service”). You are responsible for obtaining access to the Site and for any third-party fees associated with that access (such as internet service provider charges). You must provide all equipment necessary to access the Site.
1.2 To make purchases on the Site you will be required to provide your personal details, including your real name, phone number, email address, delivery address, and payment details. By providing this information, you represent and warrant that all details are accurate, current, and complete, and that you are the person referred to in the billing information provided at checkout.
1.3 Gilan Jewellers reserves the right to restrict the quantity of any item that can be shipped to a single customer or postal address.
1.4 By placing an order on the Site, you expressly authorise us to perform credit checks and to transmit or obtain information about you to or from third parties, including credit reference agencies, for the purpose of authenticating your identity, validating your payment method, and authorising purchase transactions.
1.5 You agree that we may use your personal information to conduct appropriate anti-fraud checks. Personal information may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
2. Online Orders
2.1 You may place orders for products through the Site (“Online Orders”).
2.2 All Online Orders are subject to acceptance by Gilan Jewellers and to item availability. Items in your shopping cart are not reserved and may be purchased by other customers prior to your checkout being completed.
2.3 Gilan Jewellers offers products for sale that are in stock and available for dispatch. From time to time, certain products may be available for Advance Purchase where stock is expected but not yet received. Your rights in relation to an Advance Purchase are the same as those for any standard purchase.
2.4 If Gilan Jewellers is unable to fulfil an Advance Purchase for any reason (including production or quality issues), we will notify you by email and provide a full refund to your original payment method within 30 days.
2.5 Sale & Clearance Items: Products offered at a reduced price under ‘Sale’ or ‘Clearance’ categories are sold in ‘as is’ condition. While we take reasonable care with all products, some may bear minor superficial marks. Where applicable, this will be disclosed in the product description.
2.6 Please ensure your name, address, and contact details are correct before completing your order. Gilan Jewellers will not amend or reissue tax invoices once processed with the information provided at the time of transaction.
3. Acceptance of Online Orders
3.1 Once you have placed an Online Order, you will receive an email acknowledging receipt of your order.
3.2 This acknowledgement email is NOT an acceptance of your order — it is a confirmation of receipt only.
3.3 Acceptance of your order and completion of the contract between you and Gilan Jewellers occurs when we email you to confirm that your ordered products have been dispatched.
3.4 The sale contract is concluded in New South Wales, Australia and the language of the contract is English.
3.5 Gilan Jewellers reserves the right to refuse or cancel any Online Order at our sole discretion, including where we are unable to obtain authorisation for payment, an item is out of stock, a product fails our quality control standards, there is a pricing error, or you do not meet our eligibility criteria.
3.6 We will not be liable to you or any third party for withdrawing any item from the Site, refusing to process a transaction, or unwinding any transaction after processing has begun.
4. Payment for Online Orders
4.1 Payment may be made by Visa, Mastercard, American Express (AMEX), Afterpay, Zip Pay, and any other payment methods clearly advertised on the Site from time to time.
4.2 You confirm that the credit or debit card used is yours, or that you have been specifically authorised by the cardholder to use it. All cardholders are subject to validation checks by the card issuer. Gilan Jewellers is not liable for delays or non-delivery if your card issuer refuses authorisation.
4.3 Gilan Jewellers takes reasonable care to maintain a secure Site. We will NOT store your credit or debit card details on our systems.
4.4 While we take all reasonable steps to keep your order and payment details secure, we cannot be held liable for any loss or damage resulting from unauthorised third-party access to data you provide, where this occurs without negligence on our part.
5. Delivery & Insurance for Online Orders
5.1 Gilan Jewellers will provide tracking details from our courier partner after your order has been dispatched.
5.2 Gilan Jewellers does not deliver to PO Box addresses.
5.3 Each Online Order is insured in transit from dispatch until delivery to your specified shipping address. We require a signature upon delivery, at which point responsibility for the goods passes to you. If you have nominated a gift recipient or third party, a signature at that address constitutes evidence of delivery and transfer of responsibility.
5.4 Gilan Jewellers aims to dispatch all Online Orders within 1–3 business days and to deliver within 3–7 business days. Estimated delivery times are guides only and commence from the date of dispatch. Gilan Jewellers bears no liability for delivery delays outside our control.
5.5 Complimentary delivery is offered on qualifying orders as advertised on the Site from time to time. Delivery fees may apply to certain products or order values as noted at checkout.
6. Exchange Policy — Online Orders
6.1 Gilan Jewellers will exchange products from Online Orders provided the request is made prior to dispatch, or — if the goods have already been dispatched — the products are returned within 7 days of delivery in the same condition as dispatched, with original packaging and proof of purchase.
6.2 The following conditions apply to exchanges based on circumstance:
- Pre-dispatch (Change of Mind): You may exchange your order at no cost before Gilan Jewellers dispatches the goods. If the replacement item is of higher value, the difference must be paid prior to dispatch. If of lower value, a refund of the difference will be issued to your original payment method.
- Post-dispatch (Change of Mind): A restocking fee of up to 5% of the transaction value may apply. Goods may be returned in person to any Gilan Jewellers store or sent via courier to our nominated address. Gilan Jewellers can arrange collection at your cost.
6.3 Due to health and hygiene reasons, Gilan Jewellers does not offer exchanges on earrings or body-pierced jewellery, unless the product does not comply with the provisions of the Australian Consumer Law.
6.4 Gilan Jewellers cannot exchange jewellery or watches after alteration, resizing, or engraving, or items that have been custom ordered or specially made.
6.5 Gilan Jewellers does not offer exchanges on ‘Sale’ or ‘Clearance’ items sold in ‘as is’ condition, except as required under the Australian Consumer Law.
7. Cancellation Policy — Online Orders
7.1 The following cancellation fees apply based on circumstance:
- Pre-dispatch (Change of Mind): A cancellation fee of up to 7.5% of the transaction value may apply.
- Post-dispatch (Change of Mind): A cancellation and restocking fee of up to 12.5% of the transaction value may apply. Goods must be returned to Gilan Jewellers.
- Financial Institution Cancellation: In the event your financial institution cancels or voids a transaction, Gilan Jewellers reserves the right to recover goods and charge a cancellation fee of up to 50% of the transaction value.
- Gilan Jewellers Cancellation: Where Gilan Jewellers cancels an order under these Terms, a full refund of monies charged will be issued once goods are returned to us.
8. Refund Policy — Online Orders
8.1 Subject to the other clauses herein, Gilan Jewellers offers refunds for Online Orders where you have changed your mind, less any applicable cancellation fee as set out in clause 7.
8.2 Where you believe a product is faulty or defective, Gilan Jewellers will arrange for an appropriate expert to assess the item upon its return to us. Customers who cannot return in person may do so via courier, or Gilan Jewellers may arrange collection at the customer’s cost.
8.3 If a product is confirmed as faulty or defective, and returned in its original dispatched condition:
- Gilan Jewellers will reimburse reasonable courier costs upon proof of receipt; and
- Gilan Jewellers will, at its discretion, replace the item with the same model or arrange for repair and redelivery.
8.4 If the product is assessed as not faulty, you may either accept it back or proceed with a cancellation under clause 7.
8.5 Due to health and hygiene reasons, refunds are not available for earrings or body-pierced jewellery, unless required under the Australian Consumer Law.
8.6 Refunds are not available for ‘Sale’ or ‘Clearance’ items sold in ‘as is’ condition for change of mind, unless required under the Australian Consumer Law.
8.7 Where a refund is approved, Gilan Jewellers reserves the right to deduct any payment processing commission already paid to the relevant financial institution (including Afterpay, Zip Pay, or credit card providers).
9. In-Store Purchases, Lay-by and Special Orders
9.1 This section applies only to purchases made in person at a Gilan Jewellers store and does not apply to Online Orders.
Outright Purchase
(a) Exchange: Gilan Jewellers will exchange goods returned in ‘as new’ condition with proof of purchase within 14 days of purchase (subject to the exclusions below). Only one exchange is permitted per purchase.
(b) Exclusions from exchange:
- Earrings and body-pierced jewellery (for health and hygiene reasons).
- Sale or clearance items (change of mind).
- Items modified from their original condition, including resized rings, engraved pieces, or altered watches.
- Custom and special orders — please choose carefully.
(c) Refund: Gilan Jewellers will only offer a refund where required under Australian Consumer Law. We do not offer refunds for change of mind on in-store purchases. Where a refund is provided, we reserve the right to deduct any applicable financial institution commission.
Lay-by & Special Orders
(a) A ‘Special Order’ is any item ordered in, manufactured, or altered according to a customer’s specific request. Special Orders are held on lay-by until collected.
(b) At time of placing a lay-by or Special Order:
- A minimum deposit of 20% of the total purchase price is required.
- For Special Orders, a minimum of 50% must be paid before production begins.
(c) Cancellation during the lay-by or work completion period:
- Lay-by cancellation: A fee of 20% of the total purchase amount applies; any remaining balance will be refunded.
- Special Order — materials not yet ordered: A fee of 20% applies; any excess will be refunded.
- Special Order — materials already ordered: A fee of 50% applies; any excess will be refunded.
- Once a Special Order is completed, no refund or exchange is available for change of mind. Please choose carefully.
(d) Payment schedule: A payment equal to at least 30% of the outstanding balance must be received at least every 30 days from the purchase date. If full payment has not been received within 90 days of the original purchase date, the lay-by or Special Order may be deemed cancelled and the relevant cancellation provisions will apply.
(e) Exchanges during lay-by: Subject to Gilan Jewellers’ agreement, an exchange may be made within two weeks of commencing a lay-by, provided the replacement item is of equal or greater value. Only one exchange is permitted per lay-by.
(f) Collection: Full payment must be cleared before goods are collected. All direct deposits may take 2–3 business days to confirm. If a third party is collecting on your behalf, you must notify us in writing in advance and they may be required to provide identification.
10. Repairs — Jewellery & Watches
Watches
(a) A handling, postage, and insurance fee applies to all watches sent for repair that fall outside their consumer guarantee period. This fee must be paid in full before the watch is forwarded to our third-party repair partner.
(b) Repair lead times may be up to six months or more, depending on parts availability and factors outside our control. Gilan Jewellers cannot influence repair timelines with third-party repairers.
(c) Gilan Jewellers accepts no liability in respect of watch repairs, delays arising from watch repairs, or outcomes of repairs, which the customer accepts are undertaken at their own risk.
(d) Gilan Jewellers cannot guarantee factory finish when polishing watches.
Jewellery
(a) Gilan Jewellers accepts no liability for jewellery repairs or delays arising from repairs; all repairs are accepted at the customer’s own risk.
(b) A qualified assessment will be carried out prior to any repair commencing, detailing the item’s condition and required work.
(c) Gilan Jewellers accepts no responsibility for gemstones that are chipped, cracked, fractured, damaged, or not authentic (whether discovered before or during the repair process), or for gemstones that become loose during repair.
(d) Where a treated gemstone or metal has been provided without disclosure at the time of receipt, Gilan Jewellers takes no responsibility for any change in condition resulting from the repair process.
(e) Repair warranties do not cover damage arising from wear, accidental damage, misuse, or abuse.
11. Uncollected Goods
11.1 Where an item left for repair is ready for collection, Gilan Jewellers will notify you by email (or in writing to your last known address) advising that goods are available and must be collected within 14 days.
11.2 If uncollected after 14 days, a second notice will be issued requesting collection within a further 14 days.
11.3 If still uncollected, a final notice will advise that failure to collect within 7 days will result in the goods being classified as Uncollected Goods.
11.4 Uncollected Goods may then be dealt with by Gilan Jewellers in accordance with applicable uncollected goods legislation, including referral to a licensed second-hand dealer for sale. Any proceeds, after deducting repair costs and applicable commissions, will be held in trust for the customer for 60 days before being forfeited.
11.5 This clause constitutes an agreement for the dealing of Uncollected Goods within the meaning of applicable state uncollected goods legislation.
12. Privacy Policy
12.1 Gilan Jewellers is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We take all reasonable steps to keep your personal information confidential and secure.
12.2 By providing your details to Gilan Jewellers, you consent to us using your information for the purpose of processing your purchase, managing your customer relationship, and, where applicable, for direct marketing purposes. You may opt out of marketing communications at any time by contacting us or clicking the unsubscribe link in any marketing email.
12.3 We will not provide order or purchase information to any person other than the account holder, unless authorised in writing by the account holder, required by law, or reasonably necessary to report suspected criminal activity.
12.4 We collect and hold personal information for the following purposes:
- Processing and fulfilling orders and purchases
- Managing your customer account and communications
- Improving our website and personalising your experience
- Sending promotional updates and relevant marketing (where consented)
- Conducting fraud prevention and anti-money laundering checks
- Complying with applicable laws, regulations, and court orders
- Responding to enquiries, complaints, and service requests
12.5 Your personal information may be disclosed to third-party service providers (such as logistics, IT, and payment providers) strictly for the purpose of delivering our services. We do not sell your personal information to third parties.

13. Intellectual Property
Your use of the Site grants no rights to you in relation to any copyright, trademarks, designs, or other intellectual property relating to any content on the Site. You may not reproduce, distribute, publish, or commercially exploit any content without our express written permission. You may make one copy for personal, non-commercial use only.
14. Commercial Use
The Site is for personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, reproduce, publish, licence, commercially exploit, create derivative works from, transfer, or sell any content, products, or services from this Site. Any commercial or advertising use requires prior written approval from Gilan Jewellers.
15. Limitation of Liability
To the fullest extent permitted by law, Gilan Jewellers and its officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Site or its services, including loss of profits, data, or goodwill. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
16. Indemnity
You agree to indemnify and hold Gilan Jewellers and its directors, officers, agents, and employees harmless from any claim, loss, damage, or expense (including reasonable legal fees) arising from your breach of these Terms or violation of any applicable law or third-party rights.
17. Electronic Communications
17.1 By using the Site or communicating with us by email, you consent to receiving communications from Gilan Jewellers electronically. All agreements, notices, and other communications provided electronically satisfy any applicable legal requirement for written communication.
17.2 Gilan Jewellers accepts no responsibility for inaccurate or incomplete contact details provided by you. Please notify us of any changes to ensure our records are up to date.
18. Third-Party Insurance
By accepting these Terms at point of sale, you agree that Gilan Jewellers may provide your contact details to our preferred jewellery insurance partner, who may contact you with an option to insure your purchase. Participation in any insurance offer is entirely voluntary.
19. Credit Notes & Gift Cards
Credit notes and gift cards issued by Gilan Jewellers are valid for three years from the date of issue and must be presented at the time of use by the named recipient. They are non-transferable and cannot be redeemed for cash. Gilan Jewellers credit notes and gift cards should be treated as cash and cannot be replaced if lost or stolen. They cannot be used in conjunction with other offers unless expressly stated.
20. Authenticity & Quality
Gilan Jewellers takes all reasonable care to ensure goods are accurately described. You warrant that at the time of purchase you have conducted any due diligence reasonably required to satisfy yourself that the goods are as described. Gilan Jewellers is not liable for misdescription where we have relied on our supplier’s description in good faith and conducted standard inspection practices.
21. Second-Hand & Repaired Goods
21.1 Gilan Jewellers provides no warranty for second-hand goods or in relation to any repairs. Upon receipt of repaired goods, you acknowledge and confirm that you have examined the goods and are satisfied with the workmanship.
21.2 Gilan Jewellers will not be liable for subsequent claims that goods returned from repair or service are not the same goods submitted.
22. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
23. Modification of Terms
Gilan Jewellers reserves the right to modify these Terms at any time without notice. Changes will be effective upon publication on the Site. Continued use of the Site following any changes constitutes your acceptance of the updated Terms.
24. Severance
If any provision of these Terms is found to be invalid, void, or unenforceable, that provision will be read down to the minimum extent necessary. If it cannot be read down, it will be severed without affecting the validity of the remaining provisions.
25. Agreement to Be Bound
By placing an order, making a purchase, or using the Site, you acknowledge that you have read and agree to be bound by these Terms. Execution of any receipt or purchase document at point of sale constitutes acknowledgement of these Terms.
